Vibrasi Suara Indonesia (VISI) expressed its appreciation and respect for the ruling of the Mahkamah Konstitusi Republik Indonesia.
The Court partially granted a judicial review of Law No. 28 of 2014 on Copyright, which Indonesian musicians had submitted.
According to VISI, the ruling brings much-needed clarity to music copyright governance.
In particular, it provides clearer rules on royalty payments, performance rights, and fair law enforcement for everyone in Indonesia’s music ecosystem.

The Detail of The Ruling from Mahkamah Konstitusi
In its legal considerations, the Constitutional Court outlined several key principles that strengthen legal certainty in the music sector.
First, the Court addressed the position of songwriters within the collective system.
It stated that once creators join a Collective Management Organization (LMK), they can no longer prohibit the use of their songs in live performances.
By joining an LMK, creators have already authorized the institution to manage their performance rights.
Second, the Court clearly affirmed that the obligation to pay royalties for commercial performances rests with event organizers.
It does not fall on singers or performers.
is clarification helps end long-standing interpretations that created uncertainty and placed an unfair burden on performers.
Third, the Court emphasized that criminal charges should not be used immediately or as a first step in copyright disputes.
Instead, criminal enforcement must serve as a last resort. Parties should first attempt dialogue, negotiation, and civil legal action.
Only when all these steps reach a deadlock can criminal measures apply.
VISI sees this decision as an important step forward. It helps strengthen fairness.
At the same time, it brings greater legal certainty.

Expectation From The Ruling
The ruling also restores balance between the rights and duties of creators, performers, organizers, and royalty management bodies.
The organization also stressed that the judicial review was never meant to weaken the royalty system.
Instead, it aimed to ensure that the system works fairly, collectively, and in line with sound legal practices.
Furthermore, VISI highlighted the vital role of LMK and the National Collective Management Organization (LMKN).
The organization described both institutions as key pillars of Indonesia’s music royalty system.
At the same time, VISI called on the government and related institutions to take concrete follow-up steps.
It urged them to implement the Court’s ruling through policies that are consistent, transparent, and fair.
VISI also noted that the Constitutional Court’s decision forms part of the broader process of legal development that all parties should respect.
Moving forward, VISI will continue to contribute through constructive dialogue with policymakers, music industry stakeholders, and the public.
Through these efforts, VISI aims to improve the implementation of the Copyright Law.
The organization wants the law to stay relevant to the growth of the creative industry and real-world practices.
Finally, VISI invited all music professionals and the wider public to move forward together.
The organization encouraged collaboration and respect for the legal process.
Through this shared effort, VISI hopes to help build a healthy, fair, and sustainable Indonesian music ecosystem.
